Title Insurance on First Nations Lands

As part of our continuing efforts to provide better and expanded coverage to our customers, First Canadian Title recently announced that, subject to its documentation and underwriting requirements, Title Insurance is now available to cover most types of leasehold interests in, and mortgages of, lands located within First Nation Reserves. Title insurance is often the simple and practical solution to the problems of enforceability and priority of leases and mortgages.

These interests are of five types:
Designated Land under the Indian Act
Certificate of Possession or Locatee Lands under the Indian Act
Land Codes under the First Nations Land Management Act (FNLMA)
Land covered by a Constitution in a Self-governed reserve
Dual Registry Lands

What is title insurance: A policy that guarantees that an owner properly has title to a property and can legally transfer title to someone else. A policy may protect the mortgage lender, the buyer or both.
